This platform which term includes the website located at www.saga.net.in, including mobile applications, any and all other platforms on which content is accessed, published, or distributed, and all associated services, and content made available through any of the foregoing (“Platform”) is owned and operated by RAAY Media Private Limited (“Saga”, “Us, “We”). By accessing our Platform through the mobile application, website, or using any other Saga product or service, you indicate your agreement to these Terms and Conditions of Service (“Terms”), and any other applicable Policies that govern its relationship with its users (“Users, You”).
In order to use and access certain features of the Platform, you must register and open an account (“Account”) and provide certain information about yourself as prompted by the account registration form. We reserve the right to require You to create a user Account in order to access parts or all of the Platform. You represent and warrant that:
(a) All required registration information you submit is truthful and accurate
(b) You will maintain the accuracy of such information
i) Pornography, Nudity, and Sexually Explicit Material: Inappropriate Adult or explicit material depicting illegal acts or deemed to be exploitative shall be blocked or removed from the Platform. If Your Content contains inappropriate adult or explicit material, if possible please flag the Content as containing mature content as a courtesy to other Users, so that they will have the choice whether or not to view this Content.
ii) Pedophilia, Incest, Bestiality, Exploitation and Sexual Violence or Force: Users may not publish written, image, audio or video content that promotes pedophilia, incest, bestiality, or sexual violence or force.
iii) Commercial Pornography: We do not allow content that exists for the primary purpose of monetizing pornographic content or driving traffic to a monetized pornography site.
iv) Child Pornography: We have a zero-tolerance policy against child pornography, and we will terminate and report to the appropriate authorities any User who publishes content or distributes child pornography, or who promotes material that is or purports to be child pornography on the Platform.
v) Hateful content: Users may not publish content that promotes hate toward groups based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity.
vi) Violent content: Users may not publish direct threats of violence against any person or group of people. We also ask Users not to publish content that contains graphic violence. Users may not publish instructional material regarding the creation of weapons of mass destruction.
vii) Private and Confidential Information: We do not allow the unauthorized publishing of people’s private and confidential information, such as credit card numbers, driver’s and other license numbers, and other personal information that is not publicly accessible.
viii) Impersonation: We do not allow impersonation of others through our Platform in a manner that is intended to or does mislead or confuse others.
ix) Unauthorized commercial activity: We don’t allow pages that have the primary purpose of redirecting visitors, acting as a bridge page, or driving traffic to another website. We also don’t allow content that has the primary purpose of profiting from displaying ads from any publisher network, such as pages created with little or no unique content that exists only to display ads.
x) Unlawful use of Platform: Our Platform cannot be used for unlawful purposes or for the promotion of dangerous and illegal activities. Your account may be terminated and You may be reported to the appropriate authorities.
xi) Report Content Or Comments: All users have the option to report any content or comment that they find hurtful, harmful, offensive or if it is in violation of our content guidelines. Users can report the content or comment using the in-app report function. The report function can be found at the bottom of each comment. The report function for individual content/books can be found on the book details page.
The following terms constitute our “Acceptable Use Policy”:
(a) You agree not to use the Platform to collect, upload, transmit, display, or distribute any Content (i) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual or is otherwise objectionable; (iii) that is harmful to minors in any way; (iv) that is in violation of any law, regulation, or obligations or restrictions imposed by any third party; or (v) that violates these Terms.
(b) In addition, You agree not to: (i) upload, transmit, or distribute to or through the Platform any computer viruses, worms, or any software intended to damage or alter a computer system or data; (ii) send through the Platform unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (iii) use the Platform to harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent; (iv) interfere with, disrupt, or create an undue burden on servers or networks connected to the Platform, or violate the regulations, policies or procedures of such networks; (v) attempt to gain unauthorized access to the Platform (or to other computer systems or networks connected to or used together with the Platform), whether through password mining or any other means; (vi) harass or interfere with any other user’s use and enjoyment of the Platform; or (vi) use software or automated agents or scripts to produce multiple accounts on the Platform, or to generate automated searches, requests, or queries to (or to strip, scrape, or mine data from) the Platform (provided, however, that we conditionally grant to the operators of public search engines revocable permission to use spiders to copy materials from the Platform for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials, subject to the parameters set forth in our robots.txt file).
c) We reserve the right (but have no obligation) to review any Content, and to investigate and/or take appropriate action against You in Our sole discretion if You violate the Acceptable Use Policy or any other provision of these Terms or otherwise create liability for Us or any other person. Such action may include removing or modifying Your Content, terminating your Account and/or reporting you to law enforcement authorities.
